AQHA RESPONDS TO LAWSUIT OVER REGISTRATION OF CLONES

CITES LACK OF JURISDICTION AND FAILURE TO STATE A CLAIM

On Tuesday, May 15, the American Quarter Horse Association (AQHA), the defendant in a lawsuit filed on April 23 by Jason Abraham, Abraham & Veneklasen Joint Venture and Abraham Equine Inc., answered the lawsuit by filing a Motion to Dismiss due to “lack of jurisdiction and failure to state a claim.” Abraham, a rancher from Canadian, Texas, and Dr. Gregg Veneklasen, an Amarillo, Texas, veterinarian are suing the AQHA for relief under the Sherman Antitrust Act, which is the watchdog over monopolies, due to their denial to register clones of registered Quarter Horses or their offspring that are sired by and out of registered Quarter Horses.

The Breeders’ Invitational may not have been held in 2011 due to an outbreak of EHV-1 at the Western Nationals. However, the event had to add two extra days and is projecting a close to $2.5 million purse this year, with $1 million added, due to increased entries for the May 10-26 event held in Tulsa, Okla. By the time Jaimie Snider, Burleson, Texas, and Lloyd Cox, Fort Morgan, Colo., had finished their Classic/Challenge and Special 5 Open competition, the pair had already pocketed over $154,000, with Jaime winning $79,748 and Lloyd $74,345.

Gala Nettles, who has written Gala’s Gab in every issue of Quarter Horse News for more years than I like to remember – as I was the first one to hire her to write the column, has some major issues going on – as has her husband, NCHA Futurity Champion, Ronnie Nettles. The Nettles live in Madisonville, Texas, where they own Nettles Stirrups and have a booth at major NCHA events, Ronnie trains cutting horses and Gala writes books, articles and columns for various publications.

Represented by a public defender, Rita Crundwell, who had formally been indicted on Tuesday, May 1 for stealing more than $53 million from the city of Dixon, Ill., appeared in a Rockford, Ill., courtroom this morning, pleading not guilty. The city’s chief financial officer, as comptroller and treasurer, is accused of transferring money to a secret account since 1990 and using the money to create one of the nation’s leading horse-breeding operations and buying luxury homes, a $2.1 million motor home, several trucks cars and jewelry.

DIXON COMPTROLLER THEFT NOW UP TO $53 MILLION

May 2, 2012
According to the Associated Press, Rita Crundwell, 58, the chief financial officer of the city of Dixon, Illinois, actually embezzled $53 million since 1990, rather than the $30 million the prosecutors originally thought she had siphoned since 2006 from the city of 16,000 residents, whose annual budget averaged less than $9 million. The $53 million goes back an additional 16 years.

AQHA SUED FOR REFUSING TO REGISTER CLONES AND OFFSPRING OF CLONED HORSES

Two owners of clones of AQHA-registered horses and offspring of those clones sued the American Quarter Horse Association, Amarillo, Texas, on April 23, 2012 for registration of clones and the offspring of clones. Rancher Jason Abraham, Canadian, Texas, and Dr. Gregg Veneklasen, an Amarillo, Texas, A veterinarian specializing in clones, are suing for relief under the Sherman Antitrust Act. Should they win, the plaintiffs are asking to recover threefold the damages sustained (which is allowed in antitrust cases) plus the cost of the suit, including reasonable attorney fees.

It wasn’t really his 70th birthday – that was in February – and even though it was David and Stacie McDavid’s 29th wedding anniversary, it was called David’s Birthday Party. (David explained that they were hesitant to have the party in February as it could have been really cold.) But whatever it was, it was the social event of the decade that took place at the McDavid Ranch in Weatherford, Texas, in the cutting arena on Saturday evening, April 21.

BREEDER’S INVITATIONAL ADDING DAYS DUE TO INCREASED ENTRIES

The Breeder’s Invitational (BI) announced that due to the substantial increase in entries already received for this year’s event, it has added two more days to the schedule. The event will now run from May 10-26 in Tulsa, Okla., at the Expo Square in the heart of the city. BI officials report that entries are already up 50 percent from what they were to date for their largest show in 2009. According to BI Executive Director Bob O’Bannon, the increased entries “mean that this year’s purse will be the largest we’ve ever had.” That is due to the cancellation of the 211 event due to the highly contagious equine virus.

NCHA SUPER STAKES SALES BOOSTED BY BREWER DISPERSAL AND FOREIGN BUYERS; SALE AVERAGES $13,576

Cats Peptolena, a 2005 red roan daughter of High Brow Cat out of Peptolena Lucinda by Peptoboonsmal, with over $100,000 in lifetime earnings, sold with an embryo by Pepto Rio Playboy, for $148,000. As part of the Brewer Ranch Dispersal, she was the high-selling horse of the NCHA Super Stakes Sale.

Today we have a global economy – and that flowed over into better prices for cutting horses during the NCHA Super Stakes Sale, held Saturday, April 14. Wherever one sat in the Watt arena in the Will Rogers Equestrian Center in Fort Worth, to view the sale, they could easily see, or hear, a Venezuelan or Brazilian accent, as they bid for horses or signed buyer tickets. With a gross of $2,009,200 on 148 head, the average was a very respectable $13,576. However, “RNAs (Reserve not achieved), “pass-outs” or “no sales,” were published today by Western Bloodstock, the net on the 119 horses that were marked sold was $1,639,200 for a $13,775 average. A total of 29 head did not change hands, meaning 80 percent of the sale horses changed hands.

APPELLATE COURT JUSTICES ASK TOUGH QUESTIONS IN WHITMIRE v NCHA CASE;

RECEIVE DIFFERENT ANSWERS

Attorneys for Ray and Lainie Whitmire and the National Cutting Horse Association stood before three female justices on April 10 at the Tarrant County court house, appealing their cases in an eight-year dispute and a close to six-year-old legal battle between the two parties. On Oct. 1, 2006, Lainie Whitmire filed a lawsuit against the NCHA following a dispute about her amateur/non-pro status that had been going on since 2004. Lainie was stripped of her membership and Ray Whitmire later joined the suit following his loss of membership due to the fact he was supporting his wife in her suit against the NCHA.

AQHA HAS COME UP WITH A FIVE-PANEL GENETIC TEST WHICH INCLUDES HERDA

WILL WESTERN BLOODSTOCK PUBLISH TEST RESULTS IN THEIR SALE CATALOGS AS THEY PROMISED?

Ever since the genetic disease Hereditary Equine Regional Dermal Asthenia (HERDA) has become evident in certain pedigrees of cutting, reining and reined cow horses, buyers at NCHA sales managed by Western Bloodstock could not feel confident that the horse they just bought had been tested and was negative for HERDA. A new panel of five tests marketed by the AQHA would let the buyer know if the horse they are about to purchase is a carrier of HERDA, an autosomal recessive connective tissue disorder which results in sores and lesions that heal poorly or not at all. The problem is that a carrier is not usually identifiable and carriers bred to carriers have a high percentage of producing foals that are affected, making them un-rideable and in most cases they will have to be euthanized.

MARCH MADNESS AT BILLINGS LIVESTOCK COMMISSION'S SPRING SPECIAL CATALOG SALE

April 4, 2012
Lazers Arrow Lad, a 2005 AQHA buckskin offered by Bill Johnson, Big Sandy, Mont., brought $6,000 at the Billings LIvestock March 24-25 sale event. It was a good sale with lots of good horses, mules, ponies, and teams with a weekend total of 827 head of horses and 20 roping cattle offered, with only 28 no sales. The next sale event is April 28-29.

 

A solid set of labor-ready horses, mules, and ponies filled Billings Livestock Commission‘s “Spring Special Catalog Sale,” March 24-25. Billings welcomed big numbers to the annual sale selection of “Trail, Outfitting, Guide, and Guest“ rides, including 827 horses and mules, and 20 head of Montana-raised roping cattle. Better geldings realized strong demand as 19 of the top 20 selling horses were geldings, five of them grade - and boasted an average ticket price of $5,075. The top five averaged a strong $6,680.

The high-selling horse at the Marketplace At Ardmore Sale, held March 31 in Ardmore, Okla., was Cat N Gail, a daughter of High Brow Cat out of Abigail Fletch, with earnings of $56,240 and a producer. Selling with two embryos by One Time Pepto, she was consigned by the Sunrise Ranch and sold to Dr. David Hartman for $50,000.

When the Babcock Dispersal Sale showed great numbers, everyone was wondering if the upbeat horse market was just a “flash in the pan” during a dispersal sale, or if it was here to stay. The numbers put up at this weekend’s Marketplace At Ardmore consignment auction for performance horses held March 31 at the Hardy Murphy Coliseum in Ardmore, Okla., showed the healthy market for good horses is on its way up.

Marilyn Harris, Cave Creek, Ariz., has found a way to "hurry up" the learning period when it comes to cutting! The successful horseman has fallen in love with the sport but doesn't feel she has the years it will take to be proficient...so she has a plan.

When Marilyn Harris showed up at the February Las Vegas Cutting Horse Association Show at the South Point Equestrian Center in Las Vegas, Nev., she knew she didn’t have a lifetime to learn how to become a successful cutter. It was only her third show to compete in and she was just learning about the sport of cutting.

But that didn’t deter the 63-year-old Cave Creek, Ariz., horsewoman, who had ridden most of her life, but never experienced competing in the cutting arena. She set out her plan, which included 1) finding, buying and riding the horse power that would take her to the winner’s circle and 2) make up for the lack of experience and her age by converting the five years of experience she was told it would take to be successful, into four classes at each show.

GOOD HORSES BRING GOOD MONEY AT SAN ANTONIO STOCK SHOW SALES

PERFORMING RANCH GELDINGS TOP AVERAGE AT $7,772

A capacity crowd was present in the sale pavilion for the two-day sale held Feb. 18-19 during the 63rd Annual San Antonio Livestock Exposition and Rodeo.

Performing ranch geldings seemed to be what the horse buying public was looking for at the 63rd Annual San Antonio Livestock Exposition and Rodeo sales held in San Antonio, Texas. The San Antonio Ranch Gelding Sale, held Feb. 19, saw 67 ranch geldings from nine states, compete in judged competition and average $7,772 on geldings sold. The top gelding sold for $25,000. Also the San Antonio Select Sale saw 246 horses average $3,075 on horses sold and the top horse bringing a $20,000 final bid. A capacity crowd was present in the sale pavilion for the two-day sale managed by Segraves & Associates.

I have known you Frank for many years, since you were on all committees, a director, on the Executive Board and then President, so you must be talking about the AQHA. After being involved for four years of conventions, with two years of these in the AQHA lawsuit, and six file boxes later, I thought I needed to respond. I did as you suggested and went to the convention to present my case to the Stud Book & Registration Open Committee meeting. That was where all hell broke loose! I then decided to sue the AQHA on fairness.

Five stallions topped the list of the top 10 horses selling during the Babcock Ranch Dispersal Sale held Saturday and Sunday, March 17-18, at the JL Cow Horse Arena, Whitesboro, Texas. The sale was produced by Bill Richardson of the B&R Ranch, also of Whitesboro, who had purchased all of the Babcock horses from James Bond, who had purchased them from the Bankruptcy court last year. But the heartwarming story of the sale was the sale of Captain Nice – the 11th high-selling horse.

FORT WORTH STOCK SHOW SELECT BREEDERS SALE AVERAGE UP WITH 86 PERCENT OF CONSIGNMENTS SELLING

Smoken War Jessie, a 1998 palomino gelding was the high-selling horse at the 2012 Fort Worth Stock Show's 56th Annual Select Breeders QH Sale. When the final gavel was pounded at the Fort Worth Stock Show 56th Annual Select Breeders Quarter Horse Sale held Feb. 4 in the John Justin Arena of the Will Rogers Equestrian Center in Fort Worth, 86 percent of the 73 cataloged horses had new owners. When the sale ended, it had racked up an overall average of $4,292, about $300 higher than 2011. With gross sales of $266,100, the top five head averaged $11,460, the top 10 averaged $9,510 and the top 20 averaged $7,670.

ALLEN MITCHELS FILES SUIT AGAINST NRHA AFTER REMOVAL AS PRESIDENT AND LOSING JUDGING PRIVILEGES

Allen Mitchels, former President of the NRHA, filed suit for claims of relief against the National Reining Horse Association (NRHA) on Feb. 2, 2012 in the District court in and for Oklahoma County, Okla. Jerry Ann Portwood Taylor, 81, Graham, Texas, passed away Wednesday, Feb. 29, 2012 at her home. Jerry Ann was described by her husband, 86-year-old Dutch Taylor, “as a hell of a cowgirl.” She was a true cowgirl, who when she wasn’t ranching, competed in barrel racing, roping and trick riding.

The seller was Thomas Parker, Magnolia, Texas. The stallion is a finished heeling horse, placing in the top 10 at Houston and was the 2008 San Antonio Show Circuit Amateur Heeling Champion. WHITMIRE v NCHA CASE SCHEDULED FOR ORAL ARGUMENTS ON APRIL 10

The Ray and Lainie Whitmire v National Cutting Horse Association case has been set for oral arguments on Tuesday, April 10 at 3 p.m., before a panel of Justices Lee Ann Dauphinot, Sue Walker and Lee Gabriel. Arguments will be held in the Court of Appeals for the Second District of Texas, located on the ninth floor of the Tim Curry Criminal Justice Center, Fort Worth, Texas. The court’s rules limit oral arguments to 15 minutes per side and an additional five minutes for appellant’s rebuttal. Any additional time must be requested before submission date.

Stanley Bush, 81, of Mason, Texas, passed away on Sunday, Feb. 26 at the Heart of Texas Memorial Hospital in Brady, after a lengthy illness. His brother-in-law, Matlock Rose, introduced him to the cutting horse world and he excelled as one of the top cutting horse riders in the world with a career spanning five decades.

The Whitmire’s brief to the Appeals Court was in response to Judge Tom Lowe’s overturning a Jan. 24, 2011 jury verdict and entering his own final judgment in favor of the NCHA on April 15, 2011.

The rodeo industry’s leading woman photographer, Louise Serpa, had as a goal to live long enough to make it to the Tucson Rodeo, held Feb. 18-26, for the 50th time; however, that was one goal she didn’t make. Serpa, 86, succumbed to peritoneal (stomach) cancer on Jan. 6, three years after she was diagnosed with the disease. The Tucson Rodeo, celebrating its 87th annual event, will give a tribute to Serpa, whose images are currently featured in the photo gallery at www.tucsonrodeo.com.

I’ve even had a couple people tell me that someone in power at the NCHA told them that they already had a Forensic Audit – which the Plaintiffs in the Paula Gaughan/Dean Sanders lawsuit against the NCHA had done a Forensic Audit on the records that they received – so there was no need for another one. I have personal knowledge that is absolutely false.

JEFF HOOPER RESIGNS AS EXECUTIVE DIRECTOR OF NCHA

Following weeks of speculation, it’s finally official. After 11 ½ years, Jeff Hooper is leaving the NCHA as the Executive Director to pursue other opportunities. According to President Keith Deaville, his resignation is effective March 16. The staff of the NCHA office was officially told this morning and his letter of resignation was posted on the NCHA web site. According to Deaville, the association will immediately begin searching for a new Executive Director.

In a letter dated Jan. 13, the Supreme Court of Texas, Austin, Texas, requested that the NCHA file a response to the Petition for Review previously filed by Paula Gaughan. This request was received shortly after the Freedom of Information Foundation of Texas submitted its Amicus Brief. The Foundation’s Amicus Brief supported Paula Gaughan’s position in a suit against the National Cutting Horse Association (NCHA) regarding the financial records of the association. The NCHA’s response to Gaughan’s appeal must be done by midnight on the Feb. 13 due date and can be filed electronically.

The brief, filed by the Foundation’s lawyer, Joseph R. Larsen of Sedgwick LLP, Houston, Texas, and addressed to the Supreme Court of Texas in Austin, scolded the 67th Judicial District of Tarrant County Court, Fort Worth, Texas, as well as the Second Court of Appeals in Tarrant County on their rulings for the National Cutting Horse Association (NCHA) of Fort Worth.

TAX COURT CASE EMPHASIZES IMPORTANCE OF PROFESSIONAL ADVICE

A recent case that seemed to rule correctly against a taxpayer was the Tax Court decision holding against Sandra J. Brannon of Southwest Texas with regards to her quarter horse breeding activity. [Brannon v. Commissioner IRS, TC Memo 2000-76.] The case also denied her depreciation deductions with respect to 4 emus because she was unable to prove she had purchased an interest in them, and so could not show that she had a tax basis in the animals.

BREEDERS’ INVITATIONAL TO ADD $1 MILLION TO TULSA MAY SHOW

Leonard R. Brooks, 86, Jamestown, Calif., a legend in the West Coast horse and cattle industry, left this life on his terms on Dec. 9.

Leonard R. Brooks, 86, Jamestown, Calif., left behind a life full of major accomplishments in the horse and cattle industry, when he passed away peacefully at his home on Friday, Dec. 9. According to his son, Lee, “Every morning he awoke at 5 a.m. This morning he peacefully departed at 5 a.m. with all his dignity intact.”

Brooks owned Plumb Dry when he won the NRCHA Snaffle Bit Futurity in Reno, Nev. At that time, Brooks was not yet 60 – but he was already a legend on the West Coast for his cattle and Quarter Horse accomplishments.

Jill, a top non-pro with over $511,000 in lifetime earnings and the earner of a Bronze, Silver and Gold award, and her husband, Tom, who is a top trainer with close to $1.9 million in lifetime earnings, were a winning couple in the cutting arena and Jill will be missed.

IS NCHA GETTING THE BEST DEAL FOR THE WESTERN NATIONALS?

“We found the absolute best deal we could for the dollars and Reno had an outstanding proposal,” was a quote from NCHA President Keith Deaville on the Quarter Horse website, referring to moving the Western Nationals from Ogden, Utah, to Reno, Nev., in 2012. According to the NCHA web site, the dates for the show will be April 28-May 8, 2012.

My question is, “Was that really the best deal for the dollars?” Did the Executive Committee really feel that was the best deal for the NCHA members, who will in the end be paying the bills, as well as their hotel costs? Is the NCHA really getting the best bang for their buck?

OH MISS CAROLINE’S NCHA FUTURITY WIN IS A REPEAT OF HER BROTHER’S WIN IN 2006

Craig Thompson and his wife Sasha. Craig won the 2011 NCHA Open Futurity riding Oh Miss Caroline, a full sister to Oh Cay Felix, both bred, raised and owned by Patrick and Laura Collins, and the horse he had ridden to the championship of the 2006 NCHA Futurity.

 

On the morning of Dec. 10, Patrick and Laura Collins, Lincoln, Ill., along with their gelding Oh Cay Felix were honored along with 10 others in the NCHA Futurity Open Champions Presentation which took place prior to the NCHA Futurity Seasoned Cutting Horse Sale in the Watt Arena because Oh Cay Felix had won the 2006 NCHA Futurity. But little did they know that that honor would be usurped hours later by another great honor: the championship of the 2011 NCHA Futurity on a full sister to Oh Cay Felix, who also drew up last in the finals - the same as Oh Cay Felix, and was ridden by the same rider: Craig Thompson, Buffalo, Texas.

However, these figures include the horses that did not sell. Eventually, the cream comes to the top – and that happened today during Session 1 of the Preferred Breeders Sale. But it was a long day of 200 consignments which was marred by the power in the sale arena and a whole segment of Fort Worth going out after only six horses had gone through the arena. NRCHA ELECTION POINTS TO POWER STRUGGLE WITHIN ASSOCIATION

TED ROBINSON KEPT OFF BALLOT FOR FELONY CONVICTION

Teddy Robinson is a legend in the NRCHA, having won the NRCHA Snaffle Bit Futurity seven times, yet a 1995 felony conviction for income tax evasion has suddetly stopped him from running for the Board of Directors, even though he's been on the board for 17 years.

While the National Cutting Horse Association (NCHA) was recognizing their cutting icon, the legendary trainer Buster Welch, during a sold-out Futurity Champions night at Will Rogers Coliseum during the NCHA Futurity, the National Reined Cow Horse Association’s (NRCHA) winningest trainer and showman, was being labeled a felon for a 1995 conviction for income tax evasion. As such, he is unable to run for the Board of Directors with the election being held now.

The 11 days of sales saw the number of horses cataloged and offered being down, and the total sales up, as was the average and median – by double digits! With the percent “not sold” also being down, this presents a highly successful scenario. Could this continue in the Dec. 5-10 NCHA Cutting Futurity sales?

The internet has opened up many ways to learn while living in another state – or country for that matter. And riding and training cutting horses is no different. The horse industry in foreign countries is becoming more and more enamored with cutting horses, as over the years, many well-bred cutting horses have been shipped overseas. But the biggest obstacle has been the lack of competent trainers. Rick Dennis, a cutting and working cow horse breeder and trainer from Shelby, Ala., is now working to change that.

The Marketplace At Ardmore Sale, held Nov. 5 at the Hardy Murphy Coliseum in Ardmore, Okla., saw 217 consigned horses sell under the gavels of Steve Friskup and Don Green. When the gavel had been pounded the final time, Denim And Curls, a 7-year-old blue roan mare sired by Pretty Boy Boon, a son of Peptoboonsmal, out of Lenas Glamour Doll by Lena My Way brought the highest bid of $30,000. The high seller at the Triangle Sale was Style O Lizzy, a daughter of Lizzys Gotta Player, consigned by Browne's Bar XL Ranch, Wilburton, Okla., purchased by Terri Grown, Nocona, Texas for $25,000.

On Oct. 7-8, Triangle Sales, Shawnee, Okla., held their 32nd Annual Fall Consignment Sale with the top 10 horses averaging $10,010 and the top 20 averaging $8,160. The high seller, at $25,000, was Style O Lizzy, a 2004 sorrel daughter of Lizzys Gotta Player that was consigned by Browne’s Bar XL Ranch, Wilburton, Okla., and purchased by Terri Brown, Nocona, Texas.

NOTICE: A SEARCH FOR 3 STOLEN HORSES

On Oct. 30, Susan Palm, Coronado, Calif., reported three horses stolen from her farm in Queen Creek, Ariz. “The horses were being trained by a horse trainer and the trainer and horses have all disappeared,” said Palm. “The sheriff was called by tenants at the farm,” said Palm,” when they caught the trainer leading horses out of the barn. The trainer, who was living in the bunkhouse, left with four horses; however, one that did not belong to her was later found. Asked if she owed the trainer money, Susan said, “No.”

During the 1980s, many people syndicated high-quality stallions as investment and tax strategies. These were thought to have the advantage of spreading risks of loss and sharing maintenance costs, as well as attracting investors to situations that could generate significant profits for all parties involved. Today, the Securities and Exchange Commission continues to regard stallion syndications as “non-securities,” which means that the promoter can freely advertise and solicit the general public to buy stallion shares as long as the agreement is in correct legal form.

Morgan Cromer is the third highest money-earning female trainer in the NCHA; however, at age 27, she is quickly gaining ground on the other two – Kathy Daughn and Lindy Burch. Her latest win in the 112-entry PCCHA Open Futurity, held Oct. 19-30 in Paso Robles, Calif., which was her second in four years, has boosted her earnings by $35,097. As usual, she was the only woman in the 15-horse finals and her 224 score was even more exciting as she drew up last. The total purse for the finals was $231,502.

TONI WARVELL HOSPITALIZED FOLLOWING SMALL PLANE CRASH

Toni Warvell, Weatherford, Texas, has always loved action. She’s been a trick rider, a cutter and more recently has been taking flying lessons. However, in the afternoon of Wednesday, Oct. 26, flying took an almost deadly turn when the twin-engine Beech 76 she was riding in crash-landed near Hicks field, located approximately 12 miles north of Fort Worth near Saginaw. When responders arrived, they were amazed that the three individuals had escaped the small plane that had burned completely, with only its tail being intact.

It was a scary day for horsemen in Fort Worth on Wednesday, Oct. 26 when during the ApHC World Show held at the Will Rogers Coliseum came down with a high temperature and neurological symptoms that prompted Dr. Loni Taylor, DVM to suspect EHV-1 – or the equine herpes virus. Vivid memories of the virus, which started at the 2010 NCHA Western Area Work offs came into play, where some 90 animals in 10 states became infected, with 13 dying or being euthanized, according to the Agricultural Department.

NRCHA PRESIDENT SAYS, “WE’VE ALWAYS DONE IT THAT WAY”

Now that the National Reined Cow Horse (NRCHA) main event of the year is over, the members’ attention has (prejudicial, in my opinion) turned to politics. Three members of the newly created Owners Committee, vying for seats on the Board of Directors of the NRCHA, are urging members of the NRCHA to “disagree” with proposed by-law changes regarding the appointment of officers and directors. And time is an essence as the ballots have been mailed out and 100 members must mail them back with “disagree” selected by Nov. 1, if they don’t want the proposed changes to take place. NRCHA President Kathy Gould, Raymond, Calif., says that the article in question has been in effect for years and to her knowledge all by-law changes have been made in this manner.

NCHA member and Non-Pro Hall of Famer Eddie Gail Stewart, 74, Andrews, Texas, passed away at his home Friday, Oct., 21, from an apparant self-inflicted gunshot wound. Eddie served on the Board of Directors of the National Cutting Horse Association and was inducted into the NCHA Non-Professional Hall of Fame. According to NCHA records, he won lifetime earnings of $286,370.61 in NCHA cutting competition.

MERRITT RANEW, NCHA AAAA JUDGE AND MAJOR LEAGUE BASEBALL PLAYER, LOSES HIS BATTLE WITH PROSTRATE CANCER ON OCT. 18

Merritt Thomas Ranew, 73, Leesburg, Ga., passed away on Tuesday, Oct. 18, 2011 at Langdale Hospice House in Valdosta, Ga,, following a battle with prostrate cancer. Merritt, a professional cutting horse trainer and a AAAA NCHA judge, was a former American and national League professional baseball catcher. He played for the Colt .45s (19620, Chicago Cubs (1963-1964) Milwaukee Braves (1964), California Angels (1965) and the Seattle Pilots (1969). After his baseball career, he started his 35-year-career training and showing cutting horses professionally.

High Brow Cat is the industry’s leading sire and that rolled over into the highest prices paid for horses during the Slate River Ranch Production Sale, held at the ranch in Weatherford, Texas on Friday, Oct. 14. The high-selling horse was a grandson of High Brow Cat, while the second, third and fourth high sellers were sired by him. Smooth Asa Zee, a 2005 gelding with $252,339 in lifetime earnings, sired by Smooth As A Cat, sired by High Brow Cat, out of Zee Dualy by Dual Pep. The gelding brought a $230,000 final bid, topping the sale. The second, third and fourth high sellers were all sired by High Brow Cat.

Royal Blue Boon, a 1980 daughter of Boon Bar out of Royal Tincie by Royal King) had 17 earners of $2,612,701 averaging $153,688, was owned by Elaine Hall, Weatherford, Texas, and Playboys Ruby, a 1987 daughter of Freckles Playboy out of Lenachick by Doc O’Lena, had 13 offspring earning $1,594,659, averaging $122,666. She was owned by Waco Bend Ranch, Graham, Texas.

ARE NCHA MEMBERS AT A CROSSROADS?

In addition to major issues, such as a lack of total transparency to all members within the National Cutting Horse Association, it seems that since the inception of the World Series of Cutting, the members have brought to the attention of the NCHA governing body repeated NCHA rule violations regarding World Series of cutting events. The outcome of informing the Executive Director Jeff Hooper, staff and Executive Committee members of multiple rule violations has resulted in the violations being acknowledged and potential legal liability also being acknowledged. However, it appears that the members informing the governing body of the NCHA has also resulted in association rule changes that exempt and/or favor the World Series of Cutting Tour events (currently sponsored by Mecuria Global Energy Solutions).

Held in warm weather under the beautiful blue skies of Loveland, Colo., Sept. 28-Oct. 1, the Western States Fall Limited Age Event was a great success. Entries were up over 30 percent from last year, and 18 states were represented. This is the second year using the innovative “three full go-rounds” format for the futurity horses. The total payout for the four-day event was over $125,000. The Western States affiliate leadership has a few improvements to implement, and expects an even bigger and better show in 2012.

Often enough the IRS will “trick” taxpayers by questioning whether they satisfy the Material Participation Test. This happens if the IRS concedes that your farm, livestock or horse activity is conducted for profit under the hobby loss rule. That in itself is usually a big victory. But it can turn into a dark victory if the IRS then says that your losses are “passive” and cannot be deducted against your main source of income, because you do not materially participate in the venture.

$65 MILLION AWARDED TO INVESTORS IN MARE-LEASING SCHEME

FIVE DEFENDENTS, INCLUDING DAVID AND SPENCER PLUMMER, ORDERED TO PAY SIX INVESTORS $65 MILLION IN DAMAGES IN JUDGE’S SEPT. 30 99-PAGE OPINION

Following the demise of a massive Thoroughbred mare-leasing scheme that lasted from 2001 until 2006 and eventually spilled over into the cutting horse industry, U. S. District Judge Joseph M. Hood of Kentucky issued a 99-page opinion on Sept. 30, ruling that five defendants were to pay $65 million to six former investors. Since the case fit the criteria for damages to be awarded under the federal Racketeering Influenced and Corrupt Organizations Act (RICO), Judge Hood awarded $49.4 million to the investors, which was three times their original investments, plus $15.6 million in interest.

Todd Bergen and Shiners Dun Juan took home a $100,000 after winning another National Reined Cow Horse Association Snaffle Bit Open Futurity field of 25 finalists held Sunday, Oct. 2 in Reno, Nev. Bergen scored a composite score of 657.5 on the Smart Shiner stallion out of Cremes Chic Olena, owned by Janiejill Tointon. Another former Champion, Boyd Rice, took home Reserve honors riding Moonstruck Pepto, owned by Cowan Select Horses LLC. Rice and the One Time Pepto stallion, out of Moonstruck Cat, marked a 654 to win $78,000. Reynolds claimed her record seventh Snaffle Bit Futurity title on Smart Magic Trick, out of Magical Lena.

RANCH SORTING - ANOTHER FUN AVENUE FOR YOUR CUTTING HORSE THAT WON’T “RUIN” HIM

Dave Wolfe (left) and Don Goddard started the Ranch Sorting National Championships in 2007 and currently have over 12,500 members and over 400 approved shows booked this year. Their National Finals was held in Ardmore, Okla., and featured over 5,000 two-person teams.

While weekend cuttings seem to be disappearing in parts of the United States due to various reasons, Ranch Sorting has moved in to fill the “fun” gap for many cowhorse lovers. Events are being held from coast to coast and even the AQHA has gotten into the act, with the largest classes held at their 2010 AQHA World Show being Ranch Sorting.

The reined cow horse industry's largest event annually pays out more than $1 million over the course of the 13-day show.

Even though there were 500 fewers horses than last year offered during the 13-day Keeneland September Yearling sale, the event closed with a 12.7 percent incease in total sales ($223,487,800), 18.1 percent increase in the average ($76,511) and a whopping 20 percent increase ($30,000) in the median. The increase is signaling a much-eeded positive economic indicator for the Thoroughbred industry, which hopefully, could roll over to the cutting industry's NCHA Futurity sales this fall.

C. T. Fuller, 92, an AQHA and NRHA Hall of Famer, died Monday, Sept. 5 at his home at Willow Brook Farms in Catasauqua, Pa.

Charlton Thomas (C.T.) Fuller, 92, Catasauqua, Pa., an AQHA and NRHA Hall of Famer, who basically changed the style of the reining horse and was a breeder of AQHA and NRHA Champions, died peacefully Monday, Sept. 5, at his home, Willow Brook Farms in Catasauqua, Pa. He and his wife, Alexandra Huston Fuller, had just celebrated their 65th wedding anniversary in June of this year.

WELK LAWSUIT AGAINST JEFF FOLAND DVM TO GO FORWARD SEVEN MONTHS FOLLOWING ORIGINAL DATE

Welk v Foland jury trial is centered around a well-bred cutting horse named Juan Bad Cat.

Almost seven months to the day from when a lawsuit filed by Larry and Lynn Welk, Malibu, Calif., against Jeff Foland DVM and Weatherford Equine, Weatherford, Texas, was originally scheduled to be held, a jury trial will take place. The original Feb. 14, 2011 court date was postponed due to the illness of one of the lawyers on the defense team. The new jury trial date is Sept. 13 and will be heard in State District Judge Graham Quisenberry’s 45th District Court in Weatherford, Texas. Jury selection will begin on that date.

With several horse sales coming up in the next few months, horse buyers and breeders are on edge, wondering how the prices will go. Many have horses they want to sell, and are debating which sale to put them in. That depends on what your horse’s pedigree is, its age, if it’s trained and if so, what it has won. Also, if you have a horse that doesn’t have a top pedigree or isn’t broke, you should probably consider the distance of the sale. You don’t want to put any more money into a horse that doesn’t have a chance to fetch a good price. The golden rule when consigning a horse to a sale is that you want to have the best horse in the sale. Horse traders make a living buying sub-par horses at a top sale and taking them to a sub-par sale, where they are the top horses and top the sale with the highest prices

COLORADO STATE UNIVERSITY SETS UP FUND TO HELP REBUILD EQUINE REPRODUCTION LABORATORY FOLLOWING DEVASTATING FIRE

Colorado State University's Equine Reproduction Laboratory was lost to a fire on July 26.

Colorado State University, one of the nation’s leading equine research and breeding schools, located in Fort Collins, Colo., has established a fund to help rebuild the Equine Reproduction Laboratory which was damaged by a devastating fire in the early-morning hours of July 26.

The Poudre Fire Authority, who responded to the fire which was limited to the Reproduction Laboratory’s office building, is completing the investigation into the cause of the fire. Unfortunately, the building was destroyed by fire, but there is hope that items within the building will be salvageable, including semen, oocytes or embryos stored at the facility. It is expected that most, if not all, of the high-tech equipment is a complete loss.

Brody Beaver, the only child of eight-time World Champion Cowboy Joe and his wife died on Aug. 24 at the age of 20.

 

Jenna Beaver, Joseph Broderick Beaver, nicknamed "Brody," Huntsville, Texas, the only child of eight-time World Champion Cowboy Joe Beaver and his wife, Jenna, died the morning of Aug. 24. Although it has not been confirmed, early reports are that the 20-year-old died of a self-inflicted gunshot wound.

KEITH HALL ARRESTED IN DEATH OF HIS HORSES IN WEATHERFORD, TEXAS

MILLIE MONTANA, WINNER OF 1990 NCHA FUTURITY, PUT DOWN

Keith Hall, 76, the owner of eight horses found dead on Aug. 13 and another that later had to be euthanized in the 400 block of Old Brock Road in Weatherford, Texas, was arrested on Friday, Aug. 19, by the Parker County Sheriff’s Department on a charge of cruelty to livestock animals. Accused of not provided hay or water to the horses, Hall, who lived on the property adjacent to where the horses were being kept, was released on Saturday afternoon after posting a $15,500 bond

The six-day event featured $35,500 in added money.

CODY CUSTER, CO-FOUNDER OF PBR, LOSES OLDEST SON IN CAR ACCIDENT

On Tuesday, Dec. 16, a vehicle carrying three teenagers went out of control along a curve on County Rd. 970 , five miles north of Weatherford, Okla., about 3 a.m. The two passengers who were killed included Aaron James Custer, 18, Elk City, the oldest son of Professional Bull Riders (PBR) co-founder Cody Custer and his wife Stacy of Sayre, Okla. Also killed was Edgar Drury, 18, of Olustee, while the driver, Shane Howard Frey, 19, was injured.

One Time Royalty, the 2007 stallion by One Time Pepto out of Royal Serena Belle by Shorty Lena, who was the 2010 NCHA Futurity Champion with Lloyd Cox in the saddle, recently sold to SDM Quarter Horses of Goondiwindi, Queensland, Australia. The beautiful bay stallion, from the first foal crop of One Time Pepto, scored a 230, the highest scoring run in the history of the NCHA Futurity. One Time Pepto also made history at the 2010 NCHA Futurity by siring both the Open and Non-Pro Futurity Champions, something no other sire has accomplished in the same year. The sale was announced by Matthews Cutting Horses, Warsaw, N.C. and Weatherford, Texas, who owned the stallion as well as his sire.

Buyers held their feet to the gas on the geldings as 381 head of cataloged horses were offered - 285 of them geldings - and the top two sale horses, both geldings - brought $12,000 a piece. Strong summertime sale averages include the top ten at $9,230; top 20 brought $7,737; top 50 averaged $5,622, with the top 100 coming in at $4,102.

How you look at the attached NCHA Summer Spectacular Sale results, held Friday and Saturday, July 29-30, depends on whether you are an optimist or a pessimist. When I sent out my opinion piece in my Letter From the Editor, I predicted that the Friday sale would more than likely be a “bank breaker” due to the quality of the consignors, including a dispersal of Bobby Pidgeon’s Bar H Ranche horses, and the consignments.

Those of you who are optimists, would probably say that the 49 horses from the Bar H Ranche dispersal sold the best of all, with 49 of them averaging $13,493.88 on the gross – the highest of any of the averages. The other 56 horses in the Friday sale averaged $12,596.43, while the total of all of Friday’s sale horses averaged $13,015.24 on the 105 head. Saturday’s sale only averaged $9,617.47 on the 146 head that passed through the sale ring.

APPELLATE COURT RULES FOR NCHA IN GAUGHAN V NCHA LAWSUIT

On July 28, 2011, the panel of judges in the Second District Court of Appeals in Fort Worth, Tarrant County,Texas, sent a 29-page opinion overruling each of Paula Gaughan’s three issues with the previous court ruling, and affirmed the trial court’s judgment. Members of the appellate court panel included Anne Gardner and J. J. McCoy, along with William Brigham, Senior Justice retired, sitting by assignment.

COURT OF APPEALS RULING IN HORSE CASE

Tax Court cases can be appealed to the Court of Appeals for the Circuit in which jurisdiction lies. It is extremely rare for a taxpayer to take such an appeal because of the cost involved and the unlikelihood of prevailing on appeal. However, a recent such appeal occurred in the case, Nora E. Keating and Richard L. Shearer v. Commissioner of the I.R.S., in the U.S. Court of Appeals for the 8th Circuit [544 F.3d 900]. The case involved a 7-year period, and the Tax Court ruling that the taxpayer had not carried on the horse breeding activity in a businesslike manner, was affirmed.

NCHA BALLOTING CHANGES TO BYLAWS TO BE VOTED ON BY DIRECTORS AND IF ADOPTED, ALSO BY MEMBERS JUNE 19 DURING ANNUAL MEETING AT CONVENTION

Every member of the NCHA needs to make plans to attend the 2011 NCHA Convention, scheduled June 17-19, in Oklahoma City if for no other reason to enhance protection of future voter confidentiality involving all aspects of NCHA membership voting. A change to the existing NCHA Constitution and By-laws on the way membership votes are currently counted will be reviewed and voted on by the Board of Directors at their June 17-19 meeting and then if adopted by the directors it will be considered by the members on June 19 for permanent change. This change would include votes for your local director, as well as votes for the officers and/or topics submitted to the general membership from time to time by NCHA direction (NCHA directors or membership).

North Texas trainer Clint Allen won the Australian Open Cutting Futurity riding Ducks Dux owned by John Brekelmans and sired by North Texas sire Sophisticated Catt.

After the Open Finals of the NCHA of Australia Cutting Futurity, held Sunday, June 12, trainers who lived or had lived in North Texas, and the wife of one of them, took eight of the top 11 places in the 20-horse finals. The Open Finals Champion was Weatherford, Texas trainer Clint Allen riding Ducks Dux, a daughter from the first foal crop of Sophisticated Catt, a High Brow Cat son owned by Keith Feister and Dale Koller, Gainesville, Texas. The event was held June 2-12 in Tamworth, New South Wells, Australia.

USDA PUBLISHES NEW SITUATION REPORT ON EHV-1 and AHC’S NATIONAL ISSUES FORUM TO DISCUSS BUDGET CONSTRAINTS ON USDA

The Texas Animal Health Commission (TAHC) announced in their June 8 press release that they would be discontinuing press releases on EHV-1, stating there are no new developments. Also, on the same EHV-1 subject, the USDA publishes their new Situation Report on EHV-1 and the American Horse Council’s National Issues Forum scheduled for June 21 will discuss budget constraints on the USDA.

The NCHA has announced that NCHA-approved events are set to be back in operation beginning June 6. However, NCHA Executive Committee is strongly urging that show producers exercise caution and appropriate bio-security procedures as a precautionary measure to help stop the spread of the Equine Herpes Virus-1 (EHV-1). However, many other show producers and facilities are continuing to cancel shows due to the deadly, highly contagious disease. Also Al Dunning has a story to tell after taking 11 horses to Ogden, Utah's NCHA Western Championships, where the disease was first reported.

The Texas Animal Health Commission (TAHC) has one confirmed case of the neurologic form of EHV-1 to report today. Preliminary investigation indicates no connection to the Ogden, Utah NCHA event. A Quarter Horse racehorse stabled in Ector County, TX displayed neurologic symptoms consistent with the disease, and ultimately tested positive for EHV-1.

LAINIE AND RAY WHITMIRE APPEAL JUDGE’S OVERRULING JURY TRIAL DECISION

May 20, 2011- Fort Worth, Texas

On May 13, Ray and Lainie Whitmire appealed a ruling made by Tarrant County’s 236th District Court Judge Tom Lowe on April 15, when he overturned a jury trial’s verdict that had been in the Whitmire’s favor. The appeal of the lawsuit was expected, as following a January 2011 jury trial, in which 10 of 12 jurors found the NCHA guilty of false imprisonment of Lainie and breach of contract between her lawyer and the then NCHA lawyer Eldridge Goins, Judge Lowe announced he would probably “overturn” the jury’s decision. He did just that in a Final Judgment.

USDA ISSUES SITUATION REPORT ON MAY 19

A very interesting "situation report" was issued from the USDA yesterday regarding the Equine Herpes Virus (EHV-1) The report includes a chart showing number of exposed horses, exposed premies, suspect EHV-1 cases, Confirmed cases, Suspect EHM (those that exhibit neurologic signs), confirmed EHM cases across the country. A total of 33 confirmed EHV-1 or EHM cases have been reported in eight states (CA, CO, ID, NM, OR, TX, UT and Wa). Of the 33 confrirmed cases, 32 are horses that were at Ogden, Utah at the NCHA Western Championships. Seven horses with this incident ae dead or have been euthanized.

But it was just a matter of time… and Texas is now one of many states that has confirmed cases of the dreaded, fast-spreading virus. Also, mainstream media, that usually doesn’t carry horse news, is now carrying the message of horses infected and events cancelled.

BREEDERS INVITATIONAL CANCELLED DUE TO EHV-1 CONCERNS

May 15, 2011 - Tulsa, Okla.
The Breeders' Invitational, scheduled to take place in Tulsa, Okla., May 14-28, was officially cancelled on the first day due to concerns surrounding the recent outbreak of the Equine Herpesvirus (EHV-1) following two horses being diagnosed with the disease at the NCHA Western Championships held in Ogden, Utah, April 29-May 8. The event has not been rescheduled at this time.

PCCHA CANCELS TEJON RANCH CUTTING DUE TO EXPOSURE TO EQUINE HERPESVIRUS AT OGDEN

Due to the exposure of horses on the West Coast to Equine Herpesvirus at the NCHA Western Nationals in Ogden, Utah, the PCCHA announced this afternoon that they have cancelled the PCCHA Tejon Ranch Cutting, May 19-22, held at Lebec, Calif. According to reports, a horse at Ogden died and three horses died at the Bakersfield cutting, which was held just prior to the Tejon cutting

Last Friday, May 6, HJR 111, a bill that allowed Texans to vote on placing slot machines at licensed racetracks and federally recognized Indian reservations in Texas, was passed out committee. However, that bill did not include language that addresses the horse industry needs. The bill that did include distribution of gambling funds to the horse industry is HB 2111 which never made it out of committee; however, a release from Texas H.O.R.S.E. said they would work to get language important to the horse industry into HJR 111

TRAINER KENNETH PAUL DIES WHILE AT NCHA WESTERN NATIONALS

Kenneth Paul, 35, Estancia, N.M., an NCHA trainer, passed away on Saturday after he had competed and placed in two classes at the Western National Championships in Ogden, Utah. According to reports, he got sick on Thursday and died Saturday morning. There are reports that doctors are thinking it was the swine flu and an autopsy has been done; however, the results have not yet been received.

RACETRACK SLOT MACHINE BILL HJR 111 VOTED OUT OF TEXAS HOUSE; HOWEVER, DOES NOT ADDRESS HORSE INDUSTRY NEEDS

This weekend, Texas moved a step closer to stem the flow of gambling money to neighboring states, by passing House Joint Resolution (HJR) 111 out of committee. The bill allows Texans to vote on placing slot machines at licensed racetracks and federally recognized Indian reservations in Texas – but does not include language that addresses the horse industry needs. According to Texas H.O.R.S.E., HB 2111, the bill that addresses the horse industry needs, is still pending in committee. According to a release from Texas H.O.R.S.E, if HB 2111 is not voted out of committee, they will work to get language important to the horse industry into HJR 111, although this is not their preference.

REAGON WALKER KILLED IN TRUCK/HORSE TRAILER TRAFFIC ACCIDENT

KAITLYN LARSEN INJURED

Up-and-coming PRCA steer wrestler Reagon Walker, 21, Ennis, Texas, was killed on April 23 from injuries suffered in a traffic accident. Walker and his girlfriend, Kaitlyn Larsen, a top young cutter from Weatherford, Texas, were on their way to an NCHA cutting with a living-quarter horse trailer on Highway 281 near Jacksboro, Texas. The accident involved a large truck that had pulled off the highway. Kaitlyn, the daughter of Billy Martin and Chris Larsen, was taken to the hospital; however, later was released. The horse were unhurt. Reagon was the son of 1981 World Champion Steer Wrestler Byron Walker of Ennis

FINAL JUDGMENT ON WHITMIRE CASE HAS STRANGE TWIST AND LEAVES UNANSWERED QUESTIONS

The Final Judgment in favor of the National Cutting Horse Association in the case of Lainie and Ray Whitmire v National Cutting Horse Association (NCHA), dated April 15, 2011, was signed by Judge Tom Lowe of Tarrant County’s 236th Judicial District. The Final Judgment came nine days short of three months following a Jan. 24, 2011 jury verdict in favor of Lainie Whitmire in a “Breach of Oral Contract” and “False Imprisonment” claims. However the Final Judgment included some strange twists and unanswered questions.

NCHA TO RECEIVE OVER $1.5 MILLION FROM TEXAS EVENT TRUST FUND

According to a March 31, 2011 posting of the Event Trust Fund programs from the State of Texas, a total of $1,519,310 was approved for NCHA events in 2010 and 2011 by the Comptroller’s Local Government Assistance and Economic Development Divisions.The amount includes money approved for two events that have already been held: the 2010 NCHA Futurity for $762,468 and $242,111 for the 2011 NCHA Super Stakes. Also, the upcoming 2011 NCHA Summer Spectacular will receive $514,741.

WACO BEND RANCH EVACUATED WITH WILDFIRES BURNING 55,000 ACRES IN PALO PINTO COUNTY

With over 55,000 acres already burned in Palo Pinto County due to wildfires, 40 horses from Waco Bend Ranch were evacuated with the help of NCHA members. Oswood Stallion Station took a trailer load, as did Natalie Martus, Bill and Chris Martin, Phil and Mary Ann Rapp and others from the Weatherford, Texas, area. The ranch also has a log house on the property, as well as barns. Palo Pinto County is located just west of Weatherford, Texas, which is in Parker County. The horses are being housed at Chris and Vickie Benedict’s mare barn in Weatherford.

WHITMIRE V NCHA JURY VERDICT REVERSED?

Even though neither the parties nor their lawyers in the Whitmire v NCHA case have received notice from the court, it was announced by Quarter Horse News reporter Mark Thompson today that Judge Tom Lowe signed an order on Friday, April 15, reversing the Jan. 24 jury verdict in the case. According to the article, the judge signed a final judgment not only reversing the jury’s decision but requiring Lainie Whitmire to reimburse the NCHA $345,200 in legal expenses it accrued during the case.

TRAINER DAVID KERR PASSES AWAY AT 74

April 15, 2011
David Lane Kerr, 74, Valley View, Texas, passed away Wednesday, April 13, 2011 at Presbyterian Hospital of Denton with his family by his side, after a long battle with cancer. He was born Aug. 27, 1936 in Weir, Miss., to Everette Gladney Kerr and Alice Priscilla Gordon Kerr. He married Joyce Williams on July 23, 1958 in Beaumont. She preceded him in death on May 31, 2010.

According to an article in today’s Fort Worth Star Telegram, the NCHA Triple Crown events have been made eligible for the state of Texas Major Events Trust Fund. The money squeaked by on Senate Bill 309, sponsored by Sen. Chris Harris, R-Arlington, when he added the event through a floor amendment by Harris on March 21, the same day it passed the senate.

Duals Blue Boon, consigned by Niangua River Ranch, was the high-selling horse at the Marketplace at Ardmore Sale held March 26 at the Hardy Murphy Coliseum in Ardmore, Okla. The 1992 blue roan stallion sired by Dual Pep out of Royal Blue Boon brought $30,500 from Kentucky buyers.

 

The Marketplace at Ardmore, a consignment auction for performance horses, held its second sale of the year on March 26, at the Hardy Murphy Coliseum in Ardmore, Okla. Sale manager Susie Reed summed up the sale results in four words, “The breeding stallions shined.”

We lost a great friend, East Coast professional cutting horse trainer “Joey” Schlegel, 61, lost his battle with Leukemia on March 8. He was diagnosed with Acute Mylelogenous Leukemia Oct. 13 and began a roller coaster ride of treatment. Cowboy tough, he fought to the end.

“OFFERS IN COMPROMISE” POLICY OF IRS

There are many websites and radio advertisements that offer services to help “compromise” IRS tax bills. Many of these offers make dubious claims and can entail upfront costs that exceed the results produced. Some of these promoters advertise that they can settle your tax debt for “pennies on the dollar,” which is a false and misleading claim. If you receive a tax bill from the IRS--after an audit, for example, or if you have entered into an agreement to settle a tax dispute with the auditor, IRS Appeals or the U.S. Tax Court, it is still possible to further compromise the amount due. This can be accomplished through the IRS Offers in Compromise procedure

LITTLE POLO JOE TOPS BILLINGS LIVESTOCK SALE

Little Polo Joe, a 1999 AQHA sorrel stallion by Grays Starlight and out of Little Missy Lena by Smart Little Lena was the weekend’s top sale horse selling for $36,000. With $126,854 in earnings, the pretty stallion was offered by Burke Sullivant, Gainesville, TX and purchased by Linda Collins, Olathe, Colo.

Three full days of horse sales at Billings Livestock’s “February Special Catalog Sale” Feb. 25-27 saw a good and glowing market where the top five rang the bell with a $20,000 average ticket price. They included a $124,000 money earning son of Grays Starlight, a solid-as-solid-gets head horse, an NRCHA World Champion, and two money earning daughters of High Brow Cat.

Jim Haworth was recently named the CEO of the Professional Bull Riders Inc. (PBR)

 

The Professional Bull Riders, Inc. (PBR) announced on Feb. 24 that it has selected Jim Haworth as its CEO. Haworth, who will report to the PBR Board of Directors, will lead the day-to-day business of the PBR, with oversight of all departments, including operations, finance, marketing and competition. He began his duties immediately, and will be based in the Pueblo, Colo., headquarters, building.

Jerry Carter, wife of cutting horse trainer John Carter and mother of Past NCHA President Punk Carter and Hall of Fame trainer Roy Carter, passed away Tuesday, Feb. 22, 2011, following a short illness. She was 85.

Joan Davis, the first woman to compete in a Florida Cutting Contest, passed away at 81

Joan Davis, the first woman to compete in a cutting horse contest in Florida passed away early Friday morning, Feb. 11. She was 81. She and her husband, Willard, were influential in establishing the Florida Cutting Horse Association and Joan was the first woman to show a cutting horse in the state of Florida.
